PART A – TERMS OF SERVICE

1.  Legal Framework and Mutual Assent

This digital platform and all affiliated services (“Services”) are the exclusive property of and are administered by Al Kass Ceramics, an entity duly constituted and operating under the laws of the United Arab Emirates (hereinafter referred to as the "Company," "We," or "Our"). Your affirmative act of accessing, navigating, establishing an account, submitting an order, making a reservation, or utilizing any feature of this platform or its associated Services constitutes Your explicit acknowledgment that You have thoroughly reviewed, comprehended, and irrevocably consent to be bound by these Terms in their entirety, inclusive of all incorporated policies by reference herein.
Should You dissent from any provision contained within these Terms, You are obliged to cease all utilization of the Services immediately and unconditionally.
The Company’s electronic retail operations are facilitated via the Shopify Inc. e-commerce platform, which supplies the requisite technological infrastructure.

2.  User Representations, Warranties, and Eligibility

You hereby represent, warrant, and covenant that:
(i) You have attained the age of eighteen (18) years or the legal age of majority within Your jurisdiction of residence, whichever is greater;
(ii) You possess the requisite legal capacity and authority to form binding contractual obligations under the applicable laws of the United Arab Emirates; and
(iii) All information furnished by You is accurate, truthful, current, and lawful in all respects.

Any utilization of the Services for illicit, deceitful, or otherwise unauthorized objectives is expressly prohibited.

3.  General Conditions Governing Use

The Company expressly reserves the unilateral right, exercisable at its sole and absolute discretion without incurring liability, to decline service, restrict access, or terminate accounts without prior notification.

Data transmissions across the Services that do not pertain to payment processing may traverse assorted networks in an unencrypted state. All financial and payment-related data is secured utilizing industry-standard cryptographic protocols.
You are expressly prohibited from reproducing, duplicating, copying, trading, reselling, exploiting, or deriving any commercial benefit from any portion of the Services absent the Company’s prior written authorization.

4.  Informational Integrity and User Reliance

Content disseminated via this platform is presented strictly on an "as-is" and "as-available" basis for general informational consultation. The Company disclaims all representations and warranties, whether express or implied, concerning the accuracy, adequacy, or currency of the aforementioned content.

5.  Modifications and Service Availability

The Company retains the right to alter, amend, suspend, or permanently discontinue any component of the Services, including but not limited to product pricing, specifications, and availability, at any time and without advance notice.

No liability shall accrue to the Company, its affiliates, or its representatives for any modification, suspension, or cessation of the Services.

Select products or services may be available exclusively through digital channels and may be subject to inventory or quantitative restrictions.

The Company endeavors to present product imagery and coloration with reasonable accuracy; however, variances may occur due to the technical limitations of individual display devices.

All returns, exchanges, and refunds are exclusively governed by the Company’s prevailing Return & Exchange Policy, as published on the website.

7.  Order Processing, Billing, and Account Integrity

The Company reserves the unilateral right to refuse, cancel, or limit any order for any reason at its sole discretion.
You covenant to supply and perpetually maintain accurate, current, and complete registration, account, and payment information. Provision of inaccurate or incomplete data may result in the cancellation of transactions or suspension of Services.

Any unsolicited comments, feedback, suggestions, or materials of any nature submitted by You ("Submissions") shall be deemed non-confidential and non-proprietary.

By providing Submissions, You grant the Company an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, adapt, publish, translate, and distribute such Submissions for any purpose without compensation or attribution.

10.  Prohibited Activities

You agree not to utilize the Services to:
(i) Engage in any activity that violates any applicable federal, local, or international law or regulation;
(ii) Infringe upon or misappropriate the intellectual property rights of any party;
(iii) Introduce malicious software, viruses, or any other damaging code;
(iv) Transmit content that is fraudulent, abusive, defamatory, obscene, or discriminatory;
(v) Attempt to circumvent, disable, or otherwise interfere with the security or data integrity features of the Services.

The Company reserves the right to terminate access for any conduct it deems, in its sole judgment, to be in violation of this section.

11.  Disclaimer of Warranties; Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF THE UNITED ARAB EMIRATES, THE SERVICES AND ALL PRODUCTS ARE FURNISHED WITHOUT WARRANTIES OF ANY NATURE, EITHER EXPRESS OR IMPLIED.IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.
WHERE THE EXCLUSION OR LIMITATION OF LIABILITY IS PROHIBITED BY APPLICABLE LAW, THE COMPANY'S AGGREGATE LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY SUCH LAW.

12.  Indemnification

You agree to indemnify, defend, and hold harmless the Company and its successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from Your breach of these Terms or violation of any law or third-party rights.

13.  Term and Termination

These Terms shall remain in full force and effect while You use the Services. Either party may terminate this agreement at any time.
Termination shall not relieve either party of any obligation accrued prior to the effective date of termination.

14.  Governing Law and Dispute Resolution

These Terms shall be governed by, and construed in accordance with, the substantive laws of the United Arab Emirates, without regard to its conflict of law principles.

The courts of the United Arab Emirates shall possess exclusive jurisdiction to adjudicate any dispute arising out of or in connection with these Terms.

PART B – PRIVACY POLICY

15.  Data Acquisition

The Company collects Personal Data, which may include device identifiers, browsing metadata, and transactional information, during Your interaction with the Services.

16.  Lawful Basis and Processing Objectives

Personal Data is processed to: execute purchase contracts; provide customer assistance; prevent fraudulent activity; enhance Service functionality; conduct permitted marketing communications; and comply with legal obligations.

20.  Integrated Third-Party Applications

Utilization of integrated booking or scheduling applications, such as COWLENDAR Booking Appointment, signifies Your acceptance of their respective data processing practices and functional requirements essential for service delivery. 21.  Application Data Management

Data generated within such applications is retained for a limited period following trial expiration or contract termination and is subject to deletion upon application uninstallation, barring any overriding legal retention mandates.

22.  Infrastructure and Safeguards

Applications are hosted on secure third-party infrastructure. The Company implements reasonable and appropriate technical and organizational measures designed to protect Personal Data.

23.  Data Subject Rights

Where provided under applicable data protection legislation, Users may exercise rights concerning access, rectification, erasure, or portability of their Personal Data by submitting a verifiable request.

24.  Amendments to Terms

The Company reserves the right to revise these Terms and incorporated policies at its discretion. Your continued use of the Services following the posting of revisions constitutes Your acceptance of such changes.
